Recent amendments to legislation affecting Linear Property Complaints set out significant and substantive changes.   In certain circumstances, failure to adhere to new requirements may result in issues not being heard by the Board or the dismissal of the complaint. Timelines:  Linear Property Assessment Complaint deadline is April 1, 2011;  Approximate timelines for scheduling merit hearings will be between mid-June up to November 10, 2011; and No hearings will be held after November 10, 2011 due to new decision writing timelines. Merit Scheduling Process:  A teleconference will be scheduled in the first 7 to 10 days (approximately) following receipt of complaints; This conference is to confirm party & witness availability for merit hearings, discuss time required for hearings, and confirm exchange dates;  If we are unable to contact any of the parties, a merit hearing will be scheduled in their absence. Fee Payment:  Fee payment may be made by cheque/cash/money order only; Fee payment must be received on or before the close of business (4:30 p.m. MST) April 1, 2011; Cheques/money orders must be made payable to the Minister of Finance; Payments may be left with reception at the Edmonton MGB hearing facilities at 15th Fl., Commerce Place, 10155 – 102 Street, Edmonton.
NOTE:   Electronic filing of complaints and required attachments may be made separate of fee payment, however, it is recommended that payments are received by the MGB office before electronic filing in order to avoid an invalid complaint status.   Please change the page set up to legal and adjust the scaling to  65% normal size for best printing results of the Linear Property Assessment Complaint excel form.
