Disaster Recovery Program Referrals
The Municipal Government Board (MGB) is an independent quasi-judicial review body that is separate from the Disaster Recovery Program (DRP).
On October 1, 2013, the MGB was named as a Disaster Advisory Committee to the Minister of Municipal Affairs under the Emergency Management Act. On the Minister’s request, the committee gives advice on eligibility for and amounts of disaster assistance compensation, and other matters relating to a disaster or the flood recovery.
Disaster Recovery Program (DRP) Appeal Process
When a person applies to the DRP for financial assistance, the application will be reviewed in accordance with the Alberta Disaster Assistance Guidelines. After the review is complete, the applicant will receive a written notice of ineligibility or final notice of total assistance available from the DRP. If the applicant disagrees with the notice, they can dispute it by filing an Application for Review with the Managing Director of the Alberta Emergency Management Agency. Applicants are encouraged to read the Application instructions before filing an Application for Review. The Managing Director will assign the application to an Appeals Coordinator for review and recommendation. After the review is complete, the Managing Director will issue a written notice of his or her decision to the applicant.
If an applicant disagrees with the Managing Director’s decision, the applicant may appeal the decision to the Minister of Municipal Affairs. If the Minister wishes, the applicant’s appeal may be referred to the MGB for a recommendation.
If the Minister refers a matter to the MGB, the MGB will notify the applicant it has received the request. The MGB will then appoint a case manager to facilitate the process and ensure the appeal is handled fairly and as quickly as possible. A panel of MGB members will consider the merits of each appeal. While it is anticipated that many matters will be considered in writing, in some cases the MGB may hold an in-person hearing. The process will depend on the reason that the applicant appealed to the Minister, or why the Minister requested a recommendation from the MGB. All applicants whose appeals are directed to the MGB will be advised of any hearing dates and locations.
When the MGB considers a matter referred to it by the Minister, the MGB will review the applicable legislation (links are below). Once the MGB has considered a matter, it will prepare a recommendation for the Minister. A recommendation may confirm the Managing Director’s decision, or recommend providing additional assistance to the applicant. The Minister will make the final decision on the matter.
